Department of Transportation (DOT) drug testing is federally-mandated and regulated drug testing of workers in safety-sensitive areas of public and private transportation. Congress passed the Omnibus Transportation Employees Testing Act of 1991 that was designed the insure the safety of the traveling public and of transportation employees.   •  All employees are eligible for random drug and alcohol testing.
  •  Employees who are suspected of being under the influence of drugs or alcohol can be tested. Testing cannot be based on a hunch or a guess. It must be based on specific observations of appearance, behavior, appearance or smell.
  •  Employees who are involved in accidents may be tested for drug and alcohol use.  Depending on the type of accident, the supervisor at the scene will determine whether or not to test the employee.
  •  Employees who test positive, refuse a test or violate other DOT agency provisions and regulations must be tested before they can return to work in a safety-sensitive area. The same employees will also be subject to a follow-up testing plan (developed by a substance abuse professional) that consists of at least 6 follow-up tests in the first 12 months of a worker’s return to duty.
