Consortiums

Under Federal guidelines, small companies may have their employees join with U.S. DOT Safety Sensitive employees from other companies to form a testing pool. This testing pool, call a Consortium, is where individuals are selected for random testing. DATCS has one of the largest Federal Motor Carrier Safety Administration (FMCSA) and Pipeline and Hazardous Material Administration (PHMSA) Consortiums in Texas. Our Consortium is in compliance with DOT Federal and State auditors as well as auditing agencies for companies such as Exxon Mobil, EnCana, Gulf South and many more.

Computer Generated Random Pool Management

An effective random program should use a valid scientific method of selecting individuals for testing (i.e. computer generated selection or random numbers table) and give no advance notice of the frequency of selections or individuals selected for testing. Our Compliance Department will notify you in a timely manner so you can manage your random selections accordingly.

Training

Supervisor Training: Having a Supervisors Training Program is mandated under Department of Transportation (DOT) guidelines. Supervisors are the essential elements of a company’s drug and alcohol program because they are most likely to identify indicators of drug or alcohol abuse in the workplace. Supervisors should be trained to be the first to recognize and intervene when there is unacceptable behavior.

DOT Collector’s Training: There are three main types of drug testing programs:

  • DHHS (Department of Health and Human Services) mandated
  • DOT (Department of Transportation) Mandated
  • NON-Mandated

DHHS Mandatory Guidelines control the drug free workplace programs of Federal government employees. Employees of the Environment Protection Agency, Small Business Administration and even employees of the Department of Transportation are covered by DHHS Guidelines.

The Department of Transportation (DOT) Regulations (49 CFR Part 40) require that employers conduct drug testing according to provisions in the new 49 CFR Part 40 regulations, “Procedures for Transportation Workplace Drug Testing Programs”.

NON-Mandated testing consists of testing employees in non-sensitive positions and employees of private businesses. These drug free workplace programs, while often modeled after DHHS or DOT programs, need only abide by any state laws governing drug and alcohol testing.

The procedures for collection of urine under these rules are very specific and must be followed whenever a DOT-required urine specimen collection is performed.

These guidelines apply only to employers and individuals who come under the regulatory authority of the Department of Transportation (DOT) and those individuals who conduct urine specimen collections under DOT regulations.

Our training, together with 49 CFR Part 40 and the DOT operating administration rules, provides collectors with the information needed for the proper performance of collectors’ duties.

This training also includes the five mandated error-free mock collections done under the supervision of a trainer. These mock collections are required before collectors begin collecting specimens for DOT drug tests.

It is imperative that collectors fully understand and follow these procedures

DER Training: The ‘Designated Employee Representative’ (DER) is the key company contact who provides up to date personnel records, receives test results and coordinates the random program. The proper DER training is critical to building an effective and efficient drug testing program. This training covers all aspects of the DER’s role, including record maintenance, personnel updates, DOT rules and regulations changes, types of tests, and rules of thumb in creating an active drug free workplace.

BAT (Breath Alcohol Technician) & STT (Screening Test Technician) Training: These courses cover US DOT 49 CFR Part 40 regulations and meet all of DOT’s BAT and STT qualification training requirements. They are designed to enable graduates to conduct breath alcohol or saliva tests to determine if an employee is impaired. Given that alcohol is the most abused drug, these training provide employers with a key tool in battling drug abuse and maintaining a safe work environment.

Customized Policies

A company drug policy plays a critical role in creating a drug free workplace. It is the key to a successful drug testing program. D.A.T.C.S. develops and customizes DOT and Non-DOT anti-drug and alcohol plans to comply with state and federal regulations. A sound, complete policy can also provide additional liability protection by ensuring the company’s policy and operation match. If your company or school already has an anti-drug and alcohol plan, our staff will review it to make certain your plan is an effective deterrent and supports a drug free workplace.

SAMHSA Certified Lab

There are a limited number of testing laboratories across the country that are certified by the Substance Abuse and Mental Health Services Administration (SAMHSA) as part of the Department of Health and Human Services (HHS). D.A.T.C.S. contracts with MedTox, a SAMHSA Certified Laboratory, for drug testing in compliance with 49 CFR Part 40/Part 199 & 382.

MRO (Medical Review Officer)

A Medical Review Officer (MRO) is a licensed physician who is responsible for receiving and reviewing laboratory results generated by an employer’s drug testing program. The MRO will evaluate drug test results and determine if there is a legitimate medical explanation for laboratory confirmed positive, adulterated, substituted and invalid drug test results. The MRO will also ensure the timely flow of test results and other information to employers and protect the confidentiality of the drug testing information.

Post Accident Information

 

The US Department of Transportation (DOT) requires all employees in safety-sensitive positions to be drug and alcohol tested after being involved in an accident, so long as the nature of the accident meets certain criteria outlined in the Code of Federal Regulations (http://www.dot.gov/ost/dapc/).

 

Under 49 CFR part 382.303, an accident is defined as follows:

DOT requires the drug test be performed within 32 hours of the accident and the alcohol test be performed within 8 hours. Post Accident Kits: For our motor carriers, DATCS provides DOT post-accident kits which contain collection supplies and your company’s customized Custody & Control Form identifying DATCS as your Third Party Administrator (TPA). Drivers keep the post-accident kit in their cab to ensure a prompt and accurate collection in the event of an accident taking place outside the area in which our DATCS collectors may serve them.

ALCOHOL TESTING

Breath alcohol tests are conducted utilizing Evidential Breath Testing (EBT) devices, which are on the National Highway Traffic Safety Administration’s conforming products list. Each alcohol test includes an initial and confirmatory screening (when applicable) and is conducted by a certified Breath Alcohol Technician (BAT) to meet all federal requirements.
